1. Acceptance of These Terms
These Terms of Use (“Terms”) govern your access to and use of the waitlist landing page located at www.PRESERVUS.io (the “Site”), operated by PRESERVUS, LLC, a Colorado limited liability company (“PRESERVUS,” “we,” “us,” or “our”). By accessing the Site or submitting your email through the waitlist form, you agree to these Terms. If you do not agree, do not use the Site.
2. What This Site Is
The Site is a pre-launch waitlist page. PRESERVUS is a wealth preservation and succession planning product currently in development. No product, account, or service is available for purchase or use through the Site at this time. Descriptions of planned features on the Site are aspirational, reflect our current development plans, and are subject to change without notice. Joining the waitlist does not guarantee access to PRESERVUS, a specific launch date, or any particular price or feature set.
3. Eligibility
The Site is intended for individuals age eighteen or older who reside in the United States. By using the Site, you represent that you meet these requirements.
4. No Professional Advice; No Fiduciary Relationship
Nothing on the Site constitutes legal, tax, investment, or financial planning advice, and nothing on the Site should be relied upon as such. PRESERVUS is not a registered investment adviser, broker-dealer, law firm, or accounting firm. Joining the waitlist, or any interaction with the Site, does not create an advisory, fiduciary, attorney-client, or accountant-client relationship between you and PRESERVUS.
5. Intellectual Property
The Site, including its text, graphics, logos, the chainlink mark, the PRESERVUS name, and all other content, is owned by PRESERVUS or its licensors and is protected by intellectual property laws. You may view and use the Site for your personal, non-commercial purposes. You may not copy, reproduce, modify, distribute, or create derivative works from the Site’s content without our prior written consent.
6. Acceptable Use
You agree not to:

Provide false information when joining the waitlist;

Access or attempt to access the Site through automated means, including bots, scrapers, or crawlers, without our consent;

Interfere with or disrupt the operation of the Site, including by imposing an unreasonable load on our infrastructure or launching any form of denial-of-service attack;

Intercept or monitor any data or communications transmitted to or from the Site;

Forge headers, impersonate any person or entity, or otherwise misrepresent the origin of any request or submission;

Attempt to gain unauthorized access to any part of the Site or its underlying systems;

Use the Site for any unlawful purpose.
7. Third-Party Links
The Site may link to third-party sites, including our social media accounts. We do not control and are not responsible for the content or practices of any third-party site.
8. Disclaimer of Warranties
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRESERVUS AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100), OR TWO HUNDRED DOLLARS ($200) FOR TWO OR MORE CLAIMS ATTRIBUTABLE TO ANY INDIVIDUAL USER.
10. Indemnification
You agree to indemnify and hold PRESERVUS harmless from any claims, damages, or expenses, including reasonable attorneys’ fees, arising from your violation of these Terms or misuse of the Site.
11. Governing Law and Venue
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of laws principles. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Colorado, and you consent to the jurisdiction of those courts.
12. Changes to These Terms
We may revise these Terms as the Site evolves. Continued use of the Site after a revision takes effect constitutes acceptance of the revised Terms.
13. Termination
We may remove you from the waitlist or restrict your access to the Site at any time, for any reason, including if we believe you have violated these Terms.
